Estudo de caso: X contra Y

P.A. Duffy and Company Solicitors actuou recentemente num caso de Negligência Clínica e conseguiu um acordo de £59.000,00 em nome do queixoso (X).

Naomi White, Solicitor, liderada por Gary Potter KC, tratou de um caso que envolvia um procedimento problemático de extração de um dente do siso.

The Plaintiff (X) attended the Defendant's (Y) clinic for a tooth extraction. Y advised X that they would carry out the extraction themselves, without conducting a comprehensive assessment of X or informing X of the risks and complications which were associated with this form of treatment. Y failed to appropriately consider any other treatment which X had previously and conducted a non-diagnostic radiograph which inadequately displayed the position of the inferior dental nerve - a critical factor to ensure a safe extraction. The extraction took place, and X left the clinic with exposed nerves and diminishing anaesthesia resulting in excruciating pain.

X visited their local Accident and Emergency Department and was prescribed a course of antibiotics. At this stage, X was experiencing numbness in the face. Unhappy with the situation, X attended hospital for a Radiological assessment which revealed that due to the current situation, it would take some months for a full examination.

A má gestão geral do procedimento, a falta de uma avaliação radiográfica adequada, a ausência de assistência de enfermagem, a extração prolongada e dolorosa e a não marcação das consultas de acompanhamento necessárias provocaram dores prolongadas, desconforto e dormência em X.

X instructed P.A. Duffy and Company Solicitors and secured settlement in the sum of £59,000.00.
